Occupational Driver’s License

If your driver’s license has been suspended you are prohibited by law from driving a motor vehicle. The problem is you still need to be able to go to work, take the kids to school, take your mom to the doctor, etc. There is a strong case to be made that the scenarios above are necessities. There are two basic scenarios that would make an individual need to apply for an occupational driver’s license. One, they were suspended as a result of a civil matter, or two, they were suspended as part of a DWI criminal punishment pursuant to the  Texas Transportation Code Section 521.344. Where we apply for an occupational driver’s license depends upon who suspended you. If you were suspended as part of a criminal punishment, we must apply for the ODL from the court that suspended you. If on the other hand, you were suspended as a civil matter, then we apply for the ODL in the County Court that has jurisdiction over your residence.
