Dallas Suspended Driver’s License Attorney
There are eight types of driver’s license suspensions in the state of Texas:
- Administrative License Revocation (ALR): If you get pulled over under suspicion of DWI, you will be asked to take a breath test. You consent to take the test or refuse. If you consent and fail, you get suspended. If you refuse, it will be suspended longer.
- Crash Suspension: If you are liable for causing an auto accident and don’t have insurance, you need to pay the victim’s damages. Your license will be suspended until you pay the damages in full, either in lump sum or through an approved payment plan.
- DWI Breath Test Suspension: In all practicality, this type of suspension is exactly the same as an ALR suspension (above).
- DWI Conviction Suspension: A DWI conviction (including a plea agreement) will result in a driver’s license suspension as part of the penalties. We can apply for an occupational driver’s license (ODL), a temporary license that will allow you to drive to and from work and other necessities. Violating an ODL gets you arrested for DWLS.
- Habitual Violator: People with too many traffic tickets face the possibility of having their license suspended.
- Medical Revocation: Certain types of medical conditions can result in a revocation, not just a suspension. Serious conditions can result in a lifetime suspension.
- No Auto Insurance: Get caught driving without insurance two or more times and you face a suspension.
- State Surcharge Suspension: Unlike other states, in Texas, points against your driver’s license are related to taxes. A conviction for a DWI means you pay annual extra surcharge payments. If you owe state surcharges because of driving-related convictions, your license can be suspended unless you work out a payment plan. It is important to make arrangements to pay off the surcharge(s) you owe.
Your Options In Certain Criminal Driver’s License Suspension Scenarios
- If your suspended driver’s license occurred as part of your punishment for a driving while intoxicated (DWI) conviction, you have to go back to the court that suspended your license to request an ODL.
- If you have received two no-insurance convictions and your driver’s license has been suspended, all you need to do is obtain insurance and contact DPS. You will also need to pay a reinstatement fee.
- If you have received a letter from DPS stating they will suspend your driver’s license because you were convicted of too many moving violations, you can contest the suspension in court. Your Options In Certain Civil Driver’s License Suspension Scenarios.
- If you have a suspended driver’s license because you failed to pay state surcharges from traffic ticket convictions, there is unfortunately nothing you can do to contest the suspension, unless something was placed on your driving record in error. However, you can contact DPS to create a payment plan to pay the surcharges and reinstate your driving privileges.
- If DPS suspended your license because you failed to pay a monetary award after being found guilty and at fault for a motor vehicle accident, you can seek to create a payment plan through the other party’s lawyer. If the other party does not comply, you may be able to obtain an ODL in court.
