The Texas Constitution requires that each county in the State establish between one and eight justice of the peace precincts, depending upon the population of the county. Also, depending on the population of the precinct, either one or two justice of the peace courts are to be established in each precinct. There are approximately 820 justice of the peace courts in Texas. Five of which are located in Collin County, Texas.

Justice of the peace courts have original jurisdiction in  Class C misdemeanor criminal cases, which are less serious minor offenses, such as  speeding tickets. These courts also have jurisdiction of minor civil matters. A justice of the peace may issue search or arrest  warrants, and may serve as the coroner in counties where there is no provision for a medical examiner. These courts also function as small claims courts.

In addition to class "C" traffic offenses, the Justice of the Peace Court also handles a variety of criminal class "C" misdemeanors. Some of the more common offenses include: Disorderly Conduct, Assault, Public Intoxication, Minor In Possession of Alcoholic Beverage, and Shoplifting. In cases involving alcohol violations, an alcohol awareness course is usually required.

A defendant accused of one of these crimes has the absolute right to plead Not Guilty and request a  trial by Judge or Jury. That choice is yours. You are not required to have an attorney in Court, but you may hire one if you wish. The District Attorney of Collin County will have an attorney present to prosecute the case against you. The Judge is prohibited, by Law, from discussing your ticket with you unless you have pled guilty or no contest, or the District Attorney is also present.

If you choose to go to Court, you are responsible for bringing all papers, pictures, and exhibits with you to the Court hearing. You may also contact the Court for information on how to subpoena witnesses.

If you choose to plead Guilty or Nolo Contendre (No Contest), you may either pay your fine in person at the JP Court Office designated on the ticket or you can pay the ticket online.

Disregard Traffic Control Device (DTCD) Ticket in  Parker County Justice of the Peace

In some circumstances, you may request deferred disposition from the Court. If you have a good driving record, and you are not currently on deferred disposition, you may make a request to the Court. Deferred Disposition means you will be placed on probation for a period of up to 180 days. If you successfully complete the probationary period without receiving a moving violation anywhere in the State of Texas, the original charge will be dismissed. You must also provide the Court with proof of  insurance.

There are eight JP precincts in Tarrant County, the office is an elected one, and the term of office is four years. JPs do not have to be attorneys. JP courts adjudicate the class C misdemeanor criminal cases, such as, speeding, which are filed in their courts by the various state and county agencies which are authorized to write citations, i.e. DPS, Sheriff's Department, Constable's Office, Game Wardens, Cosmetology Commission, Health and Water Departments, Plumbing Board, School Attendance offices, etc. A JP's duties also include matters such as driver's license suspension hearings, deed restriction cases, and disposition of stolen property hearings.
